By accessing and using this website, you agree to comply with these terms and all applicable laws and regulations. We reserve the right to change these terms at any time without prior notice. Continued use of the website after changes have been made constitutes your acceptance of the revised terms. 

  1. Product Availability

All products are subject to availability. While we strive to keep our inventory accurate, we cannot guarantee that all items will be in stock at the time of your order. In case of a product being unavailable, we will notify you and offer a refund or alternative product. 

  1. Pricing

Prices on our website are listed in Canadian dollars and are subject to change without notice. We make every effort to ensure accurate pricing, but errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed with incorrect pricing. 

  1. Payment Terms

Full payment is required at the time of purchase. We accept various forms of payment, as indicated during the checkout process. In the case of declined payment, the order will not be processed. 

  1. Order Acceptance

Receipt of an order confirmation does not signify acceptance of your order or an offer to sell. Aqua Magic reserves the right to accept or decline your order for any reason, including but not limited to product availability, errors in pricing or product information, or concerns regarding fraud. 

  1. Shipping and Delivery

Aqua Magic ships across Canada, and delivery times depend on location and product availability. Shipping costs are calculated at checkout. Once an order is dispatched, you will receive tracking information via email. Aqua Magic is not responsible for shipping delays caused by third-party carriers or customs clearance. 

  1. Returns and Refunds

Our return policy is available in full detail on our website. Certain products may not be eligible for return, such as electrical parts or custom orders. For eligible returns, customers must obtain an RMA (Return Merchandise Authorization) and follow the procedures outlined in our Return Policy. Returns must be made within 30 days of purchase and be in their original condition and packaging. 

  1. Warranty

Products sold by Aqua Magic may come with a manufacturer’s warranty. Refer to our Warranty Policy for details regarding eligibility and requirements, including proof of installation by a certified technician. Warranty claims are handled at the discretion of the manufacturer. 

  1. Limitation of Liability

Aqua Magic shall not be liable for any damages arising from the use or inability to use our website or products, including but not limited to direct, indirect, incidental, or consequential damages. In any event, Aqua Magic’s liability shall not exceed the total amount paid for the purchase in question. 

  1. Intellectual Property

All content, including images, text, and logos on the Aqua Magic website, are the intellectual property of Aqua Magic or its suppliers. Unauthorized use of any materials from this site is strictly prohibited. 

  1. Governing Law

These terms and any disputes arising out of or relating to the use of this website or products purchased from Aqua Magic are governed by the laws of Quebec and Canada. Any legal action must be filed in the appropriate jurisdiction within Quebec.
